My Record: Privacy Policy

The My Record app is currently in its trial period. The App and this Privacy Policy are frequently reviewed and revised. Please send your comments and clarifications to our attention at: contact@my-record.net.^[a]

Preamble

1. We at My Record are committed to complete transparency regarding the privacy of App users. This document clarifies how we use user information, the types of data we collect, the reasons for collecting it, and how it is utilized. Our goal is to enable location-based tourists (“Users”) to interact with the App, ensuring it functions properly and safely.
2. You are not obligated to provide personally identifiable information. Any such provision is voluntary and subject to applicable law.
3. This Privacy Policy is provided on behalf of My Record Ltd., company no. 516540986, located at 10 Ha’Oranim St., Zichron Yaacov. It forms part of the App’s Terms of Use.
4. This policy applies to all uses of the App across all devices and technologies.

Information Provided When Setting Up an Account

5. Tourist Visitors must not provide ^[b]personal data, such as name, phone number, email, and password, to create an account. This helps us contact Users and provide service.
6. Users may agree to receive notifications (e.g., comments, updates, features).
7. The agreement includes consent to receive marketing communications in accordance with Israeli law. Users may unsubscribe via the link or email.

Content Creators - User-Generated Content (“Creators”)^[c]

8. Users can upload personal stories, photos, videos, and documents (collectively: “Content”). This may include sensitive personal data. We process and store Content to support App functionality.
9. We may retain information from inquiries or complaints for issue resolution.

Data Collection by the Company

10. The App has an optional geolocation feature (subject to User consent) that pins Content to the User’s physical location.
11. Users may allow the App to access their camera or photo library to upload media.
12. We collect anonymized usage data (e.g., IP address, location, device information, usage patterns).
13. Cookies may be used for anonymized data collection. Disabling them may limit App functionality.
14. Anonymous data helps us ensure consistent performance, improve features, maintain security, and comply with laws.

How We Use Information

15. User data is stored in secure databases and used to support App services and enhancements.
16. Public profiles and posted Content may be visible to the general public or selected groups.
17. With the user's consent, we may contact them using their preferred methods.
18. We may store data to comply with laws, handle complaints, support investigations, or fulfil legal obligations.
19. Information will not be shared with third parties, except for:

• App service providers (bound by confidentiality).
• Legal proceedings and law enforcement.
• Preventing illegal activity.
• Minimizing legal liability.
• Court orders or official legal requests.
• Business transactions (e.g., sale or merger), under the same privacy terms.

20. We may share aggregated, non-identifiable statistical data for marketing and research.

User Rights

21. Users can update their account info at any time.
22. Users can restrict access to their photos/videos via device settings.
23. Users can delete stories (and related comments).
24. Users can delete their account and all associated Content. Some data may be retained for legal reasons.
25. Users cannot delete others’ comments. To remove such content, users must delete the related story.
26. Users can uninstall the App, but this won’t delete the account or stored data. Reinstallation will reconnect the device.
27. Users can request to review or update stored data, per Israeli privacy law.

Information Security

29. We follow standard security protocols to protect data, but we cannot guarantee against all risks.
30. We are not liable for breaches beyond our control, including force majeure or system failures.

Miscellaneous

31. Company may assign its rights or obligations to any third party.
32. Using the App signifies acceptance of this Privacy Policy.
33. If you do not accept any part of this policy, do not use the App.
34. We may revise this policy at any time. Continued use indicates acceptance.
35. Section titles are for convenience only.
36. If any clause is invalid, it will be replaced without affecting the rest of the policy.
37. This policy is governed by the laws of Israel.
38. Jurisdiction lies with the courts of Tel Aviv, Israel.
